Litigation Support Projects

Homco Site – Oklahoma City, Oklahoma – NES provided technical litigation support and cost allocation services to a defendant in a CERCLA cost recovery litigation involving a former oil field services facility. NES worked on evaluating the need for any remedial action at the site, the expected cost of the proposed remedy for the site, and appropriate cost allocation methods.

Phosphoric Acid Plant – Tulsa, Oklahoma – NES provided technical litigation support and cost allocation services to two defendants in CERCLA cost recovery litigation involving a former phosphoric acid plant and the old phosphogypsum stacks adjacent to the plant location. NES’ work involved evaluation of the need for any remedial action at the site, the expected cost of the proposed remedy for the site, and appropriate cost allocation methods.

San Gabriel Valley Site – City of Industry, CaliforniaNES provided technical support services to the plaintiff in litigation to demonstrate contribution by the former property owner at a CERCLA site located in the City of Industry, California. NES evaluated available information to determine sources, times of introduction, and paths of migration of constituents of concern in the soil and ground water. NES assisted counsel in preparing for trial and prepared for expert testimony, as necessary, prior to settlement.

Sand Springs Petrochemical Site – Tulsa, OklahomaNES provided technical support and analysis and expert witness testimony for cost recovery litigation between PRPs. NES’ analysis involved cost allocation between the major PRP and de minimis PRPs, evaluating the source and migration of contaminants in ground water, and remedy selection for the portion of the site associated with our clients. Judgment was returned in favor of our client.

Tank Removal Project – Pittsburgh, Pennsylvania – NES provided technical support and cost allocation services to a defendant in CERCLA cost recovery litigation for a tank removal action at a facility near Pittsburgh, Pennsylvania. NES reviewed the nature of the materials in the tank, the work performed for the tank removal, and whether or not a CERCLA-quality clean-up had been performed in a manner that was consistent with the NCP.
